Consent (Licence) To Open The Public Road:
In order to carry out an excavation in a public road, a person or body must have the consent of the Roads Authority or must be acting under specific legislation such as applies to Statutory and Licensed Undertakers.
A Roads Authority can allow a person or group of persons to undertake a road opening on a public road by issuing Consent (A Licence) under Section 13 (6) of the Roads Act, 1993.
It is an offence under Section 13 (10) of the Roads Act, 1993 to excavate a public road without the lawful consent of the Roads Authority.
Application:
An application for consent to open the public road must be accompanied by the following documentation:
Two copies of a location map showing the extent and location of the works and any road crossings – the scale of such maps shall be 1:2500.
Insurance Schedules / Signed Verification by Insurance Company / Broker - Insurance Policies MUST include a specific indemnity to Galway County Council – Level of Indemnity Required:
(a) Public Liability €6.5 million
(b) Employers Liability €13 million
Fee:
Administration Fee €100 (plus Road Restoration Charge and Refundable Deposit)
The cost of the consent / licence is determined by the Area Executive Engineer and consists of an administrative fee, road restoration charge and deposit.
The total fee is calculated on the following basis:
Administration Charge: €100.00
Final Restoration Charge (Surface Dressing) @ €6 per metre up to 1.0 M width and €6 per M² over 1.0 M width.
Deposit pending satisfactory Restoration:
Roads @ €20 per metre – Minimum €250.00
Footpaths @ €70 M² - Minimum €250.00
Grass Margin @ €25 M² - Minimum €250.00
Standards:
All works shall be in accordance with the NRA Specification for Roadworks 2002 & the Guidelines for the Opening, Backfilling and Re-Instatement of Trenches in Public Roads – Department of Environment, Heritage & Local Government (April 2002).
All construction works shall be in accordance with current Safety, Health & Welfare at Work (Construction) Regulations.
Control & signposting of roadworks shall be in accordance with the Traffic Signs Manual – Department of Environment, Heritage & Local Government (1996).
